Low Yat phone thief jailed.
Shahrul Anuar Abdul Aziz was jailed four months and fined RM1,000 by the Magistrate’s Court today for stealing a RM800 Lenovo smartphone at Low Yat Plaza last year.
Magistrate Nur’Aminahtul Mardiah Md Nor convicted him after ruling that the defence had failed to raise a reasonable doubt in the prosecution’s case.
“The accused is sentenced to four months’ jail and fined RM1,000, in default a further one month,” she said.
She allowed Shahrul stay of execution pending appeal.
Earlier, in mitigation, Shaharudin Ali told the court that when his client was committing the theft, he was distressed.
“He was robbed of his handphone and belongings earlier on that day (July 11, 2015),” he said.
He pleaded that although Shahrul had done wrong, he did not injure anyone. “It’s not a serious offence and the handphone only cost RM800.”
Shaharudin said the court could impose an order to have Shahrul pay back RM800 for the phone.
“He is now 23 years old and we hope the court can give him a chance to be back in society.
“Shahrul is now enrolling in a technical course at Akadeni Binaan.”
Khairul Azam Abdul Aziz and Abdul Aziz Abdul Rahman also represented Shahrul.
Deputy Public Prosecutor S Malini Anne said thievery was not a minor offence.
“The consequence of him stealing the handphone led to a racial fight around Low Yat.
“He is also not a first offender as he was previously fined for drug abuse.”
Shahrul was charged on July 14 last year under section 380 of the Penal Code for stealing the smartphone at Low Yat.
