Families are seeking general and special damages from the airline over the March 8, 2014 tragedy.
KUALA LUMPUR: The families of two Ukrainian passengers on the MH370 flight have filed a suit against Malaysian Airlines Berhad (MAB) at the High Court here today.
This comes four days before the second anniversary of MH370’s disappearance on March 8, 2014, en-route to Beijing, China, from Kuala Lumpur.
The suit was filed on behalf of Oleg Voladymyrovych Chustrak and Sergii Grygorovych Deineka, who were two of the eight Ukrainians on board the flight.
According to their lawyer Yeoh Cho Keong, the duo, both aged 44, were business partners.
“Each of them used to support their families with an individual income of about USD2 million a year.
“Their vanishing has cost their families the loss of financial support, emotional distress and burden in the form of burial costs,” Yeoh said.
Thus, the families are seeking general and special damages, and costs for the pain and suffering incurred from the loss of the aircraft from MAB, as the flight’s operator.
The plaintiff left it to the court to decide on the quantum of payment.
Yeoh said he expects more families of MH370 passengers to file cases against MAB before Tuesday, as under the Montreal Convention, an airline cannot be sued for an incident involving them after two years has lapsed.
